Nisman Case: Judge Ratifies Prosecutor Viviana Fein

The judge in charge of the Nisman case has ratified Viviana Fein in her role as the prosecutor leading the investigation. Fein had been recused by one of the plaintiffs.

Judge Fabiana Palmaghini made the decision late last night, after meeting with Fein and Alberto Nisman’s ex-wife, Sandra Arroyo Salgado. Arroyo Salgado had challenged Fein’s performance on the investigation, as she claimed the prosecutor was not moving forward in the homicide hypothesis due to her conviction that Nisman had committed suicide. Fein responded by saying she followed leads that could indicate a murder, such as investigating footprints in an emergency exit or reviewing the content of the building’s security cameras. Judge Palmaghini’s decision cannot be appealed.

This morning, shortly after being ratified, Fein issued a statement with the latest updates on the investigation. The prosecutor confirmed that a medical board will meet to examine the results of the autopsy, as Judge Palmaghini also rejected Arroyo Salgado’s attempt to cancel this.

The prosecutor will also exhort Bank of America Merryll Lynch to provide information about the account Nisman held in that US institution. Nisman’s mother, Sara Garfunkel, who found her son’s dead body, will give testimony “within the next few days.”

Fein also informed that the Metropolitan Police is studying the contents of the dead prosecutor’s computers and communications equipment, whilst the Federal Police is analysing some stains found in Diego Lagormasino’s clothing, shoes, and other items. Lagomarsino has been charged with lending Nisman the gun that killed him.

AMIA case prosecutor Alberto Nisman was found dead in his Puerto Madero apartment on 18th January. He died of a gunshot to the head.
